Guardians of Adults

This class will:

  • Introduce students to the Oregon Statutes that define the roles of fiduciaries and their responsibilities to the Protected Person and the Court.
  • Give an overview of decision-making and ethics for Guardians and Conservators.
  • Develop an understanding of how to make choices that promote the Protected Person’s values and desires.
  • Instruct how to recognize which actions require Court approval and which do not.
  • Provide practical tools for keeping track of diverse duties, staying on top of timelines, marshalling and protecting financial assets.
  • Give tips on using attorney time well, meeting Court expectations, and working with advocates and caregivers involved with the protected person.

ONLINE CLASSES: Guardian Partners has been informed that the Court strongly prefers in-person attendance for all required courses. If you live outside of your presiding County, or if special circumstances cause you to not be able to attend the class in person, you can register to take an online version of a class.

Fiduciaries appointed in Lane County must get prior approval from the Court to take an online class.

Fiduciaries appointed in Multnomah County or Clackamas County do not need prior approval to register for the online class. However, please understand that the Court will make the final decision about whether viewing the class on-line meets Court’s mandatory education requirements.

COST: The fee for the class is $100, paid at time of online registration by credit card, debit card, or Paypal, or by check or money order made out to Guardian Partners and mailed to 10814 NE Halsey St., Portland, OR 97220 or submitted on day of training.

Registrants should select the date of their session keeping in mind that they must complete a class within the time period designated by their presiding Court. Fiduciaries in Multnomah and Clackamas counties have 60 days from their appointment date. Fiduciaries in Lane County have 90 days from their appointment date.

The cost of the course may be treated as a cost of administration of the proceeding.

Guardians of Minors

This class will:

  • Introduce students to the Oregon Statutes that define the roles of fiduciaries and their responsibilities to the Protected Person and the Court.
  • Give an overview of decision-making and ethics for Guardians of Minors, and how the protected person’s needs and safety, not their own, are a key factor in decision-making.
  • Develop an understanding of how to make choices that promote the Protected Person’s values and desires.
  • Instruct how to recognize which actions require Court approval and which do not.
  • Provide practical tools for keeping track of diverse duties, staying on top of timelines, and managing protected person funds if applicable.
  • Cover basic responsibilities to improving the protected person’s quality of life , and identifying and accessing needed services.
  • Give tips on using attorney time well, meeting Court expectations, and working with advocates and caregivers involved with the protected person.

  • Provide practical tools for keeping track of diverse duties, staying on top of timelines, marshalling and protecting financial assets.
  • Cover making an estate plan, and understanding why this matters.
  • Give tips on using attorney time well, meeting Court expectations, and working with advocates and caregivers involved with the protected person.

Personal Representatives

This class will:

  • Introduce students to the Oregon Statutes that define the roles of fiduciaries and their responsibilities to the Protected Person and the Court.
  • Define probate and explain why probate is necessary.
  • Explain the purpose of the bond and letters testamentary/letters of administration.
  • Explain notice to heirs, devisees and interested parties and how to marshal assets.
  • Review the requirements of publication, Notice to creditors and payment of creditors.
  • Provide practical tools for keeping track of diverse duties, staying on top of timelines, marshalling and protecting financial assets.
  • Explain what assets need to be included in the inventory and deadlines for filing. Identify probate verses non-probate assets.
  • Discuss the process for liquidating estate assets and importance of keeping careful records.
  • Review process for closing the estate and common timelines.
  • Give tips on using attorney time well, meeting Court expectations, and working with advocates and caregivers involved with the protected person.

Trustees

This class will:

  • Introduce the Oregon Statutes that define the roles of trustees and responsibilities to the protected person and the Court.
  • Explain reasons why someone would create a trust.
  • Define key words in the trust document and explain revocable, irrevocable, testamentary, special needs trusts.
  • Review the importance of the trust document in making decisions.
  • Explain what to do if the trust document is unclear or there is disagreement.
  • Instruct how to recognize which actions require Court approval and which do not.
  • Provide practical tools for tracking diverse duties, tracking timelines, and record keeping duties.
  • Give clear instruction regarding expectations regarding ethical behavior for trustees.
  • Give tips on using attorney time well, meeting Court expectations, and working with advocates and caregivers involved with the protected.

Registration & Attendance

PLEASE NOTE: Court-Appointed Trustees are very rare, and as such Guardian Partners does not schedule regular Trustee classes. Most people are appointed as a Personal Representative. Read the letter from the Court appointing you as a fiduciary to make sure you know what type of fiduciary you are appointed as.
